Chapter 20 – Regulations on Nutraceuticals, Functional Foods and Dietary Supplements in India


Foods and food supplements claiming health benefits are fast growing food categories in India, which necessitate comprehensive yet practical regulatory framework to ensure safe food to the consumer. Food law in India was quite complicated and governed by multiple laws and diverse regulatory authorities before emergence of FSSAI in 2008 under the FSS Act 2006. The FSS regulations (2011) were notified in the official gazette which governs Licensing and Registration of food business; Packaging and Labeling; Food product standards and Food Additives; Prohibition and Restriction on sales; Import; Contaminants, toxins and residues and Laboratory and sampling analysis. FSSAI also provided specific guidance on labeling and formulated a procedure to authorize health claims, if provided with enough scientific evidence. The final notification on foods for special diet and nutraceuticals is yet to be published. This chapter provides a comprehensive overview on current status of Indian food regulations along with a snapshot of AYUSH regulations, infant nutrition, emerging Probiotic and Direct selling regulations.
